Text marketing — opt-in & consent

Some businesses that use Tally — salons and barbershops — send their own clients occasional appointment offers and promotions by text. These messages are sent by Tally Technologies LLC on behalf of the business, from a phone number assigned to that business, and show the business’s name. A client receives them only after separately opting in to marketing with that business. Marketing consent is never bundled with appointment or booking consent, and is never a condition of booking, buying, or receiving anything.

The two ways a client opts in to marketing

1. Reply YES to a one-time invitation

The business may send a client it already has a relationship with a single invitation text. The client opts in only by replying YES. The invitation reads:

“[Business name]: want first dibs on openings and the occasional deal by text? Reply YES to opt in. Msg & data rates may apply. Reply STOP anytime.”

We record the reply as the client’s consent. A client who does not reply YES is not opted in and receives no marketing.

This is not a public keyword campaign: there is no advertised keyword or short code to text. The business sends the invitation only to a specific client it already has a relationship with, and that client’s YES reply to that message is the opt-in.

2. Tick the box on the business’s booking page

On the business’s online booking page, beneath the appointment-text consent, there is a separate, unchecked-by-default box:

“Also text me openings and the occasional deal (a few a month at most). Reply STOP anytime.”

The client opts in to marketing only by ticking this box themselves. It is separate from the appointment-text consent above it, and leaving it unticked has no effect on the booking.

The client enters their own mobile number on this same booking form, just above the consent boxes, so the phone number and the marketing permission are captured together on one form:

What we send

Appointment openings, last-minute availability, and occasional promotions from the business — for example, “we have color openings this week.” Every message identifies the business and includes “Reply STOP to opt out.”

A client of Sainte Hair Salon in American Fork, Utah who has opted in to marketing might receive, from Sainte’s number on Sainte’s behalf:
